At HighKernel, our platforms and infrastructure are built around secure engineering, scalable systems, and responsible technology practices. These Terms & Conditions govern your access to and use of our services, products, APIs, applications, and digital infrastructure.

By accessing or using our services, you agree to comply with these terms.

1. Acceptance of Terms

By using HighKernel’s platforms, SaaS products, APIs, infrastructure, or related services (“Services”), you acknowledge and agree to these Terms & Conditions. If you do not agree with any part of these terms, you must discontinue use of our services.

2. Use of Services

You are responsible for all activities conducted through your account and usage of our infrastructure. Our services may not be used for malicious activity, unauthorized attacks, illegal operations, harmful network behavior, or any activity that violates applicable laws or third-party rights.

HighKernel reserves the right to suspend or terminate accounts involved in abusive, fraudulent, or security-threatening activities.

3. Infrastructure & Service Availability

We design our systems for scalability, reliability, and high performance. While we aim to maintain uninterrupted service availability, downtime may occasionally occur due to maintenance, infrastructure upgrades, security events, or external service disruptions.

Enterprise uptime commitments or SLA agreements, where applicable, may be governed separately.

4. Security & Account Responsibility

Users are responsible for maintaining the confidentiality and security of their account credentials and access systems. You agree to provide accurate account information and notify us immediately of any unauthorized access or suspicious activity associated with your account.

We implement modern infrastructure security practices, but users are also responsible for maintaining secure usage of the platform.

5. Intellectual Property

All HighKernel platforms, systems, APIs, branding assets, architecture, and proprietary technologies remain the intellectual property of HighKernel unless otherwise stated.

Users retain ownership of their own applications, data, content, and intellectual property deployed through our services.

6. Third-Party Services & Data Usage

Certain features may integrate with third-party providers such as payment gateways, analytics platforms, or infrastructure services. HighKernel is not responsible for outages, vulnerabilities, or operational issues originating from external third-party systems.

Users are responsible for ensuring that the data and content they deploy comply with applicable laws and regulations.

7. Limitation of Liability

All services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, HighKernel shall not be liable for indirect, incidental, or consequential damages, including data loss, revenue loss, operational interruptions, or service disruptions arising from the use of our platforms or infrastructure.

8. Changes to Terms

We may update these Terms & Conditions periodically to reflect changes in our technologies, services, operational practices, or legal requirements.

Continued use of our services after such updates constitutes acceptance of the revised terms.
